Terms of Service
Effective August 10, 2026
These terms are an agreement between you (“you” or “Customer”) and EmergeStack, LLC (“we”, “us”), a Georgia limited liability company, covering your use of HireWire. By subscribing or using the service you accept them. If you do not accept them, do not use the service.
1. What the service is
HireWire provides AI-powered software specialists that generate written work products, answer a telephone line, and can act on data you provide or accounts you connect. Every specialist is software. No human employee is provided, and nothing in our staffing-themed language changes that.
2. AI output is a draft, not a decision
This is the most important term in this document. Output produced by the service is generated by artificial intelligence and may be incomplete, outdated, or wrong. You are responsible for reviewing every deliverable before you send it, publish it, rely on it, or act on it. We provide a review queue for exactly this reason.
The service does not provide legal, financial, investment, tax, accounting, medical, or other professional advice, and no output should be treated as such regardless of the role title of the specialist that produced it. Where output concerns a regulated activity, you are responsible for compliance and for obtaining qualified professional review.
3. Your content, and what we do with it
You keep all ownership of the documents, text, and other material you upload or provide (“Customer Content”), and of the deliverables produced for you. You grant us a limited licence to host, process, and transmit Customer Content solely to operate the service for you, including sending it to the subprocessors listed in our Privacy Policy.
We do not sell your data, and we do not use your Customer Content to train our own models. You are responsible for having the right to provide whatever you upload.
4. Fees, billing, and renewal
Plans are billed monthly in advance: $397 (Solo), $697 (Team), $1,497 (Agency). A one-time setup fee of $1,500 applies to Team and Agency and is charged with your first payment. Subscriptions renew automatically each month until cancelled.
Each plan includes a monthly allowance of work hours, phone minutes, lead lookups, and images. If you opt in to overage at checkout, usage beyond your allowance is billed on your next invoice at $12/hour, $0.35/phone minute, $0.5/lead lookup, and $0.2/image, and is capped at twice your included allowance. If you do not opt in, the service stops at your allowance rather than charging you more.
5. Cancellation and refunds
30-day money-back guarantee.If HireWire is not right for your business, tell us within 30 days of your first payment and we will refund that month's subscription fee in full. One request per customer, on your first month.
The one-time onboarding fee of $1,500 is not refundable once we have begun that work, because it is delivered up front: loading your documents, tuning your team, and setting up call forwarding. Solo has no onboarding fee, so a Solo first month is refundable in full.
Outside the guarantee window you may cancel at any time, effective at the end of your current billing period, and you keep access until that date. Monthly fees already paid are not otherwise refundable. Nothing here limits any refund right you have under applicable law. If something went genuinely wrong on our side, contact us at support@emergestack.dev and we will deal with it fairly.
We may suspend an account for non-payment. We may terminate an account for a material breach of these terms, and will give you a reasonable opportunity to export your data unless the breach makes that inappropriate.
6. The telephone service
Plans include a phone line answered by an AI receptionist. Calls may be recorded and transcribed so the service can function and so you can review them. You are responsible for complying with call-recording and consent laws in every jurisdiction you and your callers are in, some of which require all parties to consent, and for compliance with telemarketing rules including the TCPA if you use the service for outbound contact. The phone line is not an emergency service and must never be presented as one.
7. Acceptable use
You may not use the service to:
- Impersonate another business or person, or misrepresent who the caller is speaking to
- Produce or send unlawful, deceptive, harassing, or fraudulent material
- Send unsolicited bulk messages in violation of anti-spam or telemarketing law
- Publish pages or content that phish for credentials or payment details
- Infringe anyone's intellectual property or privacy rights
- Attempt to extract, reverse engineer, or resell the underlying models or prompts
8. Connected accounts
If you connect a third-party account such as Gmail, Outlook, or a calendar, you authorise the service to access it within the permissions you grant, and you can disconnect it at any time from your dashboard. The service is deliberately built to draft rather than send email on your behalf. Your use of those third-party services remains governed by their own terms.
9. Availability
We aim to keep the service running but do not promise uninterrupted or error-free operation. The service depends on third-party providers, and their outages will affect it. We provide the service “as is” and, to the fullest extent the law allows, disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity. Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
These limits do not apply to your obligation to pay fees, to either party's liability for fraud or wilful misconduct, or to anything that cannot be limited under applicable law.
11. Changes
We may update these terms. If a change is material we will give notice by email or in the product before it takes effect. Continuing to use the service after that means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. The courts located in Georgia have exclusive jurisdiction, except that either party may seek injunctive relief where appropriate.
